Troopers Hit With Gunfire During Chase

Daniel J. Campbell, also known as Daniel Huerta, didn’t get away despite a desperate attempt that had him leaning out a window, pumping a sawed-off shotgun and firing at troopers. A jury convicted him this month of several charges in the chase and shooting. He faces anywhere from 13 to 250 years in prison when he is sentenced in January. “It was all over a (tail)light violation,” prosecutor John Alagaban said. “But (Campbell) was a felon. And, hell be damned, he was not going to be taken that night.” He almost took two troopers with him. In the words of one of the troopers, they were bored in the early morning hours of a frigid day last February — patrolling westbound on Interstate 80. A low-riding car merged onto I-80 in front of troopers Andrew Phillips and Steven Peck. Phillips was driving. They spotted a broken taillight on the Hyundai Accent. They radioed in its license plate and informed dispatchers they were going to perform a traffic stop. The Hyundai’s driver didn’t obey. Marissa D. McCormack, who is awaiting trial, initially put on her right turn signal and steered toward the shoulder. Then, however, she veered back onto the Interstate. Phillips blared his sirens at McCormack. She still didn’t pull over. As the chase moved from I-80 to I-680, Peck shined a spotlight through the back window of the Hyundai. The troopers could see a passenger but little movement as the Hyundai braked and wound around to the West Center Road exit. The Hyundai turned right onto West Center near Rockbrook Village. As the pursuit approached 108th Street, Peck called out from the passenger seat: “Watch out — they’re going to slam on the brakes.” At that point, the passenger leaned out of the window and fired at the cruiser with a sawed-off shotgun. The windshield cracked right in front of Peck’s face. “Shots fired! Shots fired!” Peck hollered. Trooper Phillips veered left, then accelerated toward the Hyundai, still fleeing south. Phillips: “You hit?” Peck: “I don’t know.” Breathless, Peck radioed that the suspect vehicle was southbound on 108th Street. “Stay back, stay back,” he called out to Phillips.
